01 Purpose and acceptance
This website allows customers to purchase clothing and other products sold by DIADE 2013, S.L. at a distance. Certain products may be manufactured or prepared in Italy, while sales and invoicing are handled by the company identified on this page.
Accessing the website, registering and submitting an order imply acceptance of the conditions applicable at the time of purchase.
02 Products
- Product pages provide, where available, size, colour, composition, images and the main product features.
- Images are for illustrative purposes. Colours and details may vary slightly depending on the screen, lighting conditions or normal textile-industry tolerances.
- Availability is subject to stock. If an item becomes unavailable after an order has been placed, the customer will be informed and any amount already paid for that item will be refunded.
- DIADE may update collections, descriptions and product ranges or withdraw products from sale, without affecting orders already confirmed.
03 Prices, taxes and invoicing
- Prices are stated in euros and are displayed before the purchase is confirmed, together with the applicable taxes according to the product and destination.
- Standard shipping is included in the order price and no separate shipping charge is applied. Any customs duties, taxes or import charges applicable at destination are excluded unless otherwise stated.
- For destinations subject to customs procedures, the recipient may be required to pay duties, import taxes or handling charges imposed by the authorities or carrier.
- Invoices are issued by DIADE 2013, S.L. using the billing information supplied by the customer.
04 Orders and contract formation
Before submitting an order, the customer may review and correct the selected products, quantities, addresses and other information entered.
The contract is formed when DIADE sends the order confirmation by email. The confirmation summarises the purchased products, amounts, charges and delivery address.
DIADE may reject or cancel orders in the event of obvious errors, unavailability, suspected fraud, incomplete information or inability to fulfil the order. Any amount already collected will be refunded.
05 Payment
Available payment methods are displayed during checkout and may include payment cards, PayPal or other authorised services. Payments are processed by specialised providers and are subject to their applicable terms.
The order is processed after payment authorisation has been confirmed. If payment is declined or not completed, the order cannot be fulfilled.
06 Shipping and delivery
- Delivery times shown on the website are estimates and may vary depending on availability, destination, carrier and any customs checks.
- The customer must provide a complete and accurate address and ensure that delivery can be completed.
- Upon delivery, customers should inspect the packaging and promptly report any visible damage to both the carrier and DIADE.
07 Right of withdrawal and returns
Where provided by consumer law, the customer has 14 calendar days from delivery to notify DIADE of the decision to withdraw from the purchase without giving a reason.
- The notice must be sent to [email protected] and must include the order number and the items concerned.
- Products must be returned intact, unused beyond what is necessary to inspect their nature, characteristics and fit, and complete with labels and accessories.
- Unless the product is defective, DIADE made an error or otherwise stated, the direct cost of returning the goods is borne by the customer.
- The refund is made using the same payment method used for the purchase, unless otherwise agreed, within the statutory period. DIADE may withhold the refund until the goods or proof of return have been received.
- The right of withdrawal may be excluded in the cases provided by law, including personalised or made-to-order products and sealed goods unsuitable for return for hygiene reasons once opened.
08 Conformity and legal guarantee
Consumers benefit from the statutory conformity guarantee provided by applicable law. For new goods purchased in Spain, the statutory liability period is generally three years from delivery.
The customer must inform DIADE of the defect, quoting the order number and providing the information needed to assess the issue. Where goods lack conformity, the remedies provided by law will apply.
The guarantee does not cover damage caused by misuse, normal wear and tear, accidents, inadequate care, alterations or washing contrary to the product instructions.
09 Liability
DIADE is liable within the limits established by applicable law. Nothing in these Terms limits any mandatory rights granted to consumers.
DIADE is not liable for delays or failure caused by circumstances outside its reasonable control, without prejudice to the customer’s statutory rights.
10 Intellectual property
The website, the DIADE brand, logos, text, photographs, graphics, designs and other content are protected by intellectual and industrial property laws.
The content may not be reproduced, distributed, altered or otherwise used without prior authorisation, except where permitted by law.
11 Personal data protection
DIADE 2013, S.L. processes the personal data required to manage accounts, orders, payments, invoicing, shipping, returns and customer service in accordance with applicable law.
Data may be shared with payment, logistics, hosting and support providers to the extent necessary to provide the service.
12 Promotions, codes and discounts
Promotions, discount codes and vouchers may be subject to expiry dates, minimum spend, exclusions, usage limits and specific conditions communicated with the offer.
Unless otherwise stated, promotions cannot be combined. DIADE may reject or cancel benefits obtained through misuse, manipulation or fraud.
13 Changes to these terms
DIADE may update these Terms to reflect legal, technical or commercial changes. The version applicable to each order is the version available and accepted at the time of purchase.
14 Applicable law and disputes
These Terms are governed by Spanish law, without prejudice to any mandatory rules that may apply in the consumer’s country of residence.
In the event of a dispute, the customer may contact DIADE at [email protected] to seek an amicable solution. Consumers may also contact the competent alternative dispute resolution bodies.
For consumers, jurisdiction lies with the courts determined by applicable law. In all other cases, unless mandatory law provides otherwise, the courts of Las Palmas de Gran Canaria shall have jurisdiction.
15 Final provisions
- If any provision is found to be invalid or unenforceable, the remaining provisions will continue in effect.
- Failure to exercise a right does not constitute a waiver of that right.
- Translated versions are provided for convenience. In the event of an interpretative discrepancy, the Spanish version shall prevail, without prejudice to the consumer’s mandatory rights.
